The success of the pursuit or defense of a request for a contract adjustment is
often keyed to the thoroughness of the research and preparation.
The MCM approach involves the following steps:
- INITIAL INTERVIEW to develop a basic understanding of the project, to
acquaint ourselves with the parties involved and to define the problems at
hand.
- REVIEW OF THE CONTRACT DOCUMENTS to determine whether a basis for
recovery exists.
- DETERMINE THE BASIS OF ENTITLEMENT by reviewing the contract language
and the actions of both parties as it pertains to the problem.
- ESTABLISH JUSTIFIED AREAS OF COMPENSATION by evaluating the areas of
possible recovery or denial under the contract.
- DEFINE CAUSE AND EFFECT RELATIONSHIPS and determine the impact which
they had on the project.
- CALCULATE THE DAMAGES of the problems and associated impact in both time
and money.
- PREPARE CLAIM DOCUMENTS OR REBUTTAL including both a narrative
description of the issues and a graphical presentation of the findings.
- PRESENTATION OF OUR OPINIONS AND CONCLUSIONS to in-house management,
legal council, the opposing side or an arbitration board.
